Dive Brief:
- A proposed class action lawsuit was filed against Chobani by a California consumer, alleging negligence and a breach of its implied merchantability warranty.
- The yogurt maker received complaints in August regarding bloated and fizzy yogurt cups, which it later said was due to a "common mold," which Chobani didn't reveal as Mucor circinelloides until Sept. 6.
- The U.S. Food and Drug Administration revealed Monday that it received 220 reports of cramps, nausea, headaches and diahrrea related to the yogurt, but says the reports don't prove causation.
Dive Insight:
This late-August mold issue continues to plague the New Berlin, N.Y., yogurt maker, which, to its credit, issued a voluntary recall once reports began to surface. Still, the delay in revealing the mold responsible. Despite being common in dairy products like blue cheese, Mucor circinelloides is still an indicator of spoilage and can be detrimental to health. Replacing the spoiled yogurt may not be enough to appease consumers, and this bad bit of PR is certainly not what the company needed on the heals of its U.S. Air Force hemp seed debacle and issues raised by anti-GMO consumers regarding its "natural" branding.
