Dive Brief:
- Walmart has been named in lawsuit alleging it is misleading consumers with a store-brand juice it labels as “100% Cranberry Pomegranate.”
- According to the suit, filed in the northern district of Florida, the drink contains only trace amounts of pomegranate or cranberry juice.
- The allegations are similar to those made by POM Wonderful against a line of juices made by Coca-Cola's Minute Maid brand.
Dive Insight:
When the Supreme Court gave the go-ahead to POM Wonderful to sue Coca-Cola last month, it became inevitable that we'd see a surge in false-labeling lawsuits for all sorts of things.
The only thing surprising here -- and it is actually quite surprising -- is that anyone would actually still try to sell something so very, very, very similar to what the Supreme Court ruled is fair game for a lawsuit.
