Dive Brief:
- Two firms at the center of lawsuits filed by Hershey over trademark infringement have agreed to stop selling products with names similar to those of the chocolate maker's brands.
- TinctureBelle Marijuanka LLC, a medical marijuana producer based in Colorado, was selling products with names like Ganja Joy in packaging that was reminiscent of Hershey's Almond Joy candy.
- Conscious Care Cooperative, based in Seattle, agreed to halt sales of products such as "Reefer's Peanut Butter Cups."
Dive Insight:
When news first broke about the pot with candy names, it was pretty clear that Hershey didn't think the parody marketing was funny. Food Dive said then that it would probably "take awhile before the pot vendors learn some of the basic rules of branding, trademarks, and corporate reputation."
Now it appears that the pot companies are learning how to play the game. But there's still room for improvement. Which raises the question: Has anyone told Disney that there's a pot dealer in Colorado with the fairy-like name of TinctureBelle?
